PARTICIPANT WAIVER, RELEASE, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Location: Kool Kids Club - 274 S. Rampart Blvd Los Angeles, CA 90057

1. GENERAL RELEASE AND ACKNOWLEDGMENT

This Waiver, Release, Assumption of Risk, and Indemnification Agreement (“Release”) is voluntarily executed by the undersigned (“Participant/Parent/Guardian”). I acknowledge that this Release is intended to provide broad legal protections to Looma Space, its agents, owners, officers, managers, shareholders, affiliates, volunteers, employees, and all entities acting on its behalf.

2. ASSUMPTION OF INHERENT RISKS

I understand that participation in activities at Looma Space involves inherent risks, both known and unknown. These include, but are not limited to:

Physical Injury: Serious injury, paralysis, or death resulting from falling, landing improperly, or contact with others.
Health Risks: Exposure to infectious diseases and viruses (including COVID-19 and any other respiratory or communicable pathogens/variants).
Equipment/Technology: Risks associated with the use of interactive attractions, including any AI-integrated systems or automated equipment.
Negligence: Risks arising from the actions, inactions, or negligence of Looma Space employees or other participants.

BY SIGNING THIS, I VOLUNTARILY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES.

3. MEDICAL FITNESS AND EXPENSES

I certify that the Participant(s) are physically, mentally, and emotionally fit for the activities.

Self-Responsibility: I agree to use the facilities in a safe and responsible manner.
Medical Costs: I acknowledge that if medical assistance is required (emergency care, hospitalization, etc.), such assistance shall be at my own expense. I assume the risk of any pre-existing medical conditions that might be exacerbated by these activities.

4. COMPLIANCE WITH 2026 PUBLIC HEALTH & SAFETY

I agree to comply with all current safety protocols and public health guidelines provided by Looma Space and local authorities. I release Looma Space from any claims regarding the contraction of any disease or virus while on the premises.

5. PHOTO, VIDEO, AND AI-MARKETING RELEASE

In connection with the use of Looma Space facilities, I consent to the recording of my and/or the Child’s physical likeness and voice through any means (“Recordings”).

Usage: I authorize Looma Space to use these Recordings in perpetuity for advertising, promotion, and social media, including use in AI-enhanced marketing tools.
Opt-Out Right: (Please check below if you DO NOT consent to the use of Recordings for marketing purposes. Otherwise, consent is granted by default.)

6. PARENT/GUARDIAN INDEMNIFICATION

AS THE INDIVIDUAL SIGNING THIS ON BEHALF OF A MINOR, I AGREE TO FULLY INDEMNIFY AND HOLD HARMLESS LOOMA SPACE from any and all claims, causes of action, or losses (including attorney fees) arising out of the Participant’s use of the facilities. This includes any injury or damage caused by the Participant’s own negligent or intentional acts.
